Terms of service

These terms are an agreement between you and Affection Health Care LLC, a Wyoming limited liability company, which operates Gaveki. By using Gaveki you agree to them. If you do not agree, do not use Gaveki.

Gaveki helps you get things out of your head, choose what matters today, and start.

Gaveki is not a medical device. It does not diagnose, treat, cure or prevent ADHD or any other condition. It is not therapy or medical advice and it is not a substitute for a qualified professional. If you are struggling with your health, talk to a clinician. If you are in crisis, contact your local emergency services.

You need an accurate email address — it is how you sign in, because there is no password. You are responsible for what happens under your account. Tell us at hello@gaveki.com if you think someone else has access to it.

You must be at least 13 years old to use Gaveki. If you are under 18, you need a parent or guardian’s permission.

Much of Gaveki works without an account at all, saved on your device. Signing in is what makes your list follow you to another one.

Everything you write in Gaveki belongs to you. We do not claim ownership of it.

You give us only the permission we need to run the service for you: to store your content, display it back to you, and send it to our AI provider when you ask for an AI feature. That permission ends when you delete the content, or when your account is deleted.

We do not use your content to train AI models and we do not sell it. The privacy policy has the detail.

• Do not use Gaveki to break the law, to harm someone, or to harass anyone.
• Do not try to break into it, overload it, or get around its limits.
• Do not automate requests at a volume a person would not make.
• Do not resell it or pass your access to someone else.
• Do not use it to build a competing product.

We may suspend an account doing any of these. If we do, we will tell you why.

Gaveki uses AI for some features. AI gets things wrong. It may misread what you wrote, suggest the wrong task, or produce something that does not make sense. That is why the task list is shown to you for editing before anything is saved, rather than saved for you.

You are responsible for your own decisions. Do not rely on Gaveki for anything where being wrong would cause real harm.

AI features have usage limits so that one person cannot run up costs for everyone. Those limits can change. If we change them in a way that materially reduces what you paid for, we will tell you.

Gaveki Pro is a subscription. Payments are handled by Stripe, on Stripe’s own page — we never see your card number. What each plan includes, and what Pro costs, are shown on the plans page before you pay, and are not restated here so that this page cannot contradict them.

• Your subscription renews automatically at the price shown when you subscribe, until you cancel.
• You can cancel at any time from your settings. Cancelling stops the next charge; it does not refund the period you are already in, and you keep Pro until that period ends.
• Cancelling is not made harder than subscribing.
• If we change the price of an existing subscription, we will tell you before it takes effect and you can cancel.
• If a payment fails, you keep Pro for a short grace period and then return to the free plan. You do not lose your data.
• Free trials, when offered, convert to a paid subscription unless you cancel before the trial ends.

Refunds are not automatic, but we are reasonable. Email hello@gaveki.com.

The free plan is real and we intend to keep it. It has limits, and those limits can change. We will not delete your data because you are on the free plan.

Gaveki shows routines and reminders inside the app: a routine whose time has passed is visibly due when you open it.

Gaveki does not send browser notifications or push notifications. That is not built. The routines screen says so where the switch would be, rather than offering a control that would do nothing. The one exception is the iOS and Android apps, which ask your device to raise a local notification when a focus timer ends — scheduled and fired by the device, with nothing sent to us.

Do not rely on Gaveki for anything where a missed reminder would matter.

We are actively building Gaveki. Features will be added, changed and sometimes removed. If we remove something significant that you rely on, we will tell you, and if we withdraw the service we will give reasonable notice and a way to get your work out first.

You can stop using Gaveki whenever you like, and you can delete your account yourself from Settings. You will be asked to type the word DELETE first, because there is no undo. Everything you wrote goes with it; if you have a subscription it is cancelled before anything is deleted, and if that cancellation fails nothing is deleted at all. The privacy policy says exactly what goes and what stays.

We can suspend or close an account that breaks these terms, or that we reasonably believe is being used to harm someone. Except in urgent cases we will tell you why and give you a chance to fix it.

Gaveki is provided as is. We do not promise it will be uninterrupted, error free, or that it will suit your particular purpose. To the extent the law allows, we disclaim implied warranties.

To the extent the law allows, Affection Health Care LLC is not liable for indirect, incidental, special or consequential damages, or for lost profits, lost data, or missed opportunities.

Our total liability to you for any claim relating to Gaveki is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred United States dollars.

Some places do not allow these limits. If you live somewhere that does not, this section applies to you only as far as the law allows, and nothing here limits liability that cannot legally be limited.

These terms are governed by the laws of the State of California, United States, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in California, and you and we agree to the jurisdiction of those courts.

These terms and the privacy policy are the entire agreement between us about Gaveki. If a court finds part of this unenforceable, the rest stays in force.
